Attorney General Chris Bentley won't say whether an attack on a lesbian couple will be prosecuted as a hate crime.

Bentley says he's outraged by any hate-based crime and that such matters will be prosecuted to the fullest extent of the law.

He told the provincial legislature today that if sexual orientation is determined to be a factor in a crime, it's reflected in the sentencing.

Bentley was responding to NDP critic Cheri DiNovo, who wants the Crown attorney in Durham Region to say publicly whether the attack on the couple will be treated as a hate crime.

Jane Currie and her partner Anji Dimitriou were picking up their three children at a school in Oshawa, Ont., on Nov. 3 when a man hurled insults and started hitting them.

Mark Scott, 43, of Oshawa, has been charged with two counts of assault causing bodily harm.
